A publisher who wants to disseminate their radio programming over digital broadcasting must first obtain the license to disseminate radio programming over digital broadcasting in an individual geographical area, allowing them to digital their programming over the network and in the area for which the license was given.
Pursuant to Article 82 of the Media Act, licenses to disseminate over digital broadcasting are awarded by the Agency after a completed public tender, while taking into account the provisions of the Electronic Communications Act and on the basis of a reasoned proposal from the Broadcasting Council. The public tender is initiated by a decision published in the Official Gazette of the Republic of Slovenia, in which the Agency also determines the conditions and criteria for selecting providers for the broadcasting of programs in the tendered area and defines the conditions that the provider must comply with when broadcasting the program for which it will obtain the broadcasting right. At the same time, the Agency shall also publish the tender documentation on its website. The public tender procedure itself shall be conducted by a special impartial commission appointed by the Director of the Agency, while the Broadcasting Council shall submit a reasoned proposal for selection after reviewing the bids and the commission's report. The right to broadcast in the tendered area is granted by the Agency by means of a decision issued in an administrative procedure.

Interested broadcasters may submit a call for tenders to the Agency. In addition to the interest of broadcasters, the Agency must also take into account the available capacity on existing networks when launching the call for tenders.
