Responsibilities for content control

Under the Media Act (ZMed), the Audiovisual Media Services Act (ZAvMS) and the Accessibility of Products and Services for Persons with Disabilities Act (ZDPSI), the Agency is responsible for the supervision of radio and television programmes, on-demand audiovisual media services, video-sharing platforms and e-books.

Under the Media Act, the Agency supervises:

  • Compliance with the basic programming requirements and restrictions laid down in the licence to carry out radio or television broadcasting activities (e.g. broadcasting time, proportions of each content genre);
  • the achievement of the own-produced content ratios;
  • the proportions of Slovenian audiovisual works;
  • Achievement of Slovenian music shares;
  • compliance with restrictions on the broadcasting of advertising content in radio programmes.

Under the Audiovisual Media Services Act, the Agency monitors:

  • Appropriate labelling or technical protection of content that could harm the development of children and minors;
  • the achievement of the European audiovisual content shares;
  • compliance with the provisions governing advertising and sponsorship (e.g. disguised advertising, inadmissible advertising or advertising causing harm to minors, advertising that exceeds the scope of advertising, advertising of alcoholic beverages, tobacco products, medicines and medical devices and health services) - more on advertising rules and product placement;
  • respect for the right to brief coverage of all major events and other events of public interest;
  • Respect for the right to follow events on the list of major events;
  • the provision of information for the purpose of monitoring under the MPAA;
  • respect for the prohibition on incitement to violence or hatred and incitement to commit terrorist offences;
  • plans to improve accessibility for people with disabilities;
  • compliance with the rules applicable to video-sharing platforms (incitement to violence or hatred against a group of persons or a member of such a group, dissemination of content constituting a criminal offence, etc.).

Under the Law on Accessibility to Products and Services for Persons with Disabilities, the Agency monitors:

The Agency will verify the compliance of services with the conditions laid down by law, handle complaints and reports, and verify the rectification of non-compliances identified, and will focus in particular on preventive action and awareness-raising among service providers. The Agency also has powers to monitor the enforcement of disability rights in certain other areas of its work, all information on which is available in the online entry point for people with disabilities.

The Agency carries out monitoring ex officio or on the basis of a complaint, which can be made here. If the Agency finds a violation of laws or regulations, it also initiates infringement proceedings against the offender.
